General Terms and Conditions - Ondilo

Article 1: Definitions
- "ICO" refers to the connected object that links the pool to the user. ICO also designates the smartphone application the user downloads. The application is developed and sold by ONDILO, functioning exclusively with the ICO connected device.
- "ONDILO" is the manufacturer and seller of connected pool-related objects and accessories, including free maintenance and updates for the ICO application and access to personal accounts for order tracking and after-sales support.
- "Website" refers to the ONDILO web platform for purchasing and promoting products and services, accessible at www.us.ondilo.com.
- "Consumer" refers to a natural person acting outside of any professional activity to purchase a product for personal or family use.
- "US Consumer Protection Laws": These terms incorporate applicable consumer protection regulations in the United States, including but not limited to:
- Federal Trade Commission (FTC) Act
- Uniform Commercial Code (UCC)
- California Consumer Privacy Act (CCPA) (if applicable)
- Additional state consumer protection laws
Article 2: Scope of Application
These General Terms and Conditions (GTCs) define the rights and obligations between:
- ONDILO, a simplified joint-stock company, registered under B 818 423 626 000 14, headquartered at 162 Avenue Robert Schuman, 13760 Saint-Cannat, France, operating in the US market through us.ondilo.com.
- Consumers, as defined above, regarding the sale of products and services via www.us.ondilo.com.
These GTCs apply to all products and services sold on the website, except the ICO mobile application, which is governed by its own Terms of Use during installation.
By purchasing from ONDILO, the consumer acknowledges full understanding of the Products, Services, and Terms, and accepts the GTCs without reservation.
ONDILO reserves the right to amend these terms, with the applicable version being the one in effect at the time of order validation.
Article 3: Purpose & Services
These GTCs govern sales, define consumer rights, and outline ONDILO's obligations regarding:
- The sale of ICO connected objects and accessories.
- Maintenance and updates of the ICO application.
- Access to an online account for order tracking and after-sales support.
Article 4: Prices
- Prices are displayed in US dollars ($) and include taxes unless otherwise stated.
- Shipping and handling fees are additional and appear at checkout.
- ONDILO reserves the right to modify prices at any time, but confirmed orders will be honored at the price applicable at checkout.
- Products remain ONDILO's property until full payment is received.
Article 5: Orders
5.1 Placing an Order
- Orders can be placed via www.us.ondilo.com.
- Consumers must create a personal account and provide necessary details for processing orders and shipping.
- Before confirming an order, consumers can review and modify details.
- Clicking "Confirm" constitutes a legally binding contract between the consumer and ONDILO.
5.2 Order Changes
- Once confirmed, orders are final.
- Modifications may be considered if requested promptly via email or phone and approved by ONDILO.
- Changes may impact delivery times and pricing.
5.3 Order Validation
- ONDILO reserves the right to refuse orders for any legitimate reason, including:
- Payment issues
- Stock availability
- Fraud concerns
Article 6: Payment
- Accepted Payment Methods:
- All major credit and debit cards
- PayPal
- Apple Pay
- Google Pay
- Shop Pay
- All Shopify-supported payment methods
- Orders are processed only after full payment is received.
- ONDILO is not responsible for online payment processing malfunctions.
Article 7: Right of Withdrawal (Returns & Refunds)
Consumers have 30 days from the receipt of goods to exercise the right of withdrawal without justification.
Return Conditions:
- The product must be returned complete, undamaged, and in original packaging.
- Consumers bear return shipping costs.
Refund Process:
- ONDILO will refund payments (excluding shipping fees) within 14 days of receiving the returned product.
Exceptions to Withdrawal Rights:
- Custom-made or personalized products.
- Unsealed software or digital content.
- Products damaged by the consumer.
Article 8: Product Availability
- ONDILO products are available while supplies last.
- If an item is out of stock, the consumer will be notified and offered:
- A replacement product.
- A full refund.
Article 9: Legal Warranties & Consumer Protection
9.1 Product Conformity & Defects
- US consumers are protected under the Uniform Commercial Code (UCC) and applicable state laws.
9.2 Warranty Periods
- Conformity Warranty: 12 months from delivery.
- Hidden Defects Warranty: 12 months from defect discovery.
9.3 Claim Process
Consumers must report defects within 7 days of noticing the issue by emailing us-contact@ondilo.com.
Article 10: Delivery
- Delivery is made to the address provided at checkout.
- ONDILO is not liable for delays beyond 2 months, especially due to:
- Force majeure (strikes, natural disasters, supply chain disruptions).
- Customer unavailability for delivery.
- Shipping costs are calculated based on destination, weight, and dimensions.
10.1 Geographic Availability
- ONDILO products are available for shipping exclusively within the United States.
Article 11: Liability & Limitations
ONDILO is not liable for:
- Internet disruptions, hacking, or malware.
- Misuse of the product by the consumer.
- Force majeure events preventing order fulfillment.
ONDILO's maximum liability is limited to the product's purchase price.
Article 12: Intellectual Property
- All website content, product designs, and branding remain ONDILO's exclusive property.
- Unauthorized use, reproduction, or distribution is strictly prohibited.
Article 13: Personal Data & Privacy
ONDILO collects personal data only for order processing and customer service.
- Data is stored securely in compliance with applicable US privacy laws, including CCPA where applicable.
- Consumers may request access, modification, or deletion of their data via us-contact@ondilo.com.
Article 14: Governing Law & Dispute Resolution
- Disputes are subject to state and federal laws where the consumer resides.
- Consumers may attempt to resolve disputes through applicable state consumer protection agencies prior to litigation.
